- Recall the specific statutory wording of the Prohibited Transaction provisions
- Associate the statutory language with DOL’s interpretation of the statutory language
- Understand the utility of relying upon one or more Prohibited Transaction Exemptions (“PTEs”)
- Remember that relying upon a Prohibited Transaction Exemption does not mean a Prohibited Transaction exists
- Understand the utility of doing a full Prohibited Transaction analysis in connection with a perceived PTE compliance failure
- Understand strategies to avoid certain Prohibited Transactions (even when relying upon a PTE)
- Differentiate the enforcement authority that exists between DOL (EBSA) and Treasury (IRS)
- Reinforce your understanding of DOL’s interpretive authority over Prohibited Transactions and PTEs
- Connect your risk tolerance with PTE compliance and strategies to avoid certain Prohibited Transactions
- Enhance your understanding on how to navigate corrections for actual or perceived Prohibited Transaction violations
Within this session, Erin will also focus on and highlight certain PTEs that may reinforce these learning outcomes.
