Success is as dangerous as failure in modern times. A trust which has several assets which have multiplied in value can be a surcharge issue if one fails to timely diversify out of the now-concentrated position. Modern portfolio damages authorized by the Third restatement of Trusts and the Prudent Investor Act can hammer a trust department for inattention to investment allocations. Class actions are burgeoning, as idle Tobacco lawyers look for new fields to conquer-a trivial mistake is no longer a small issue ...when there are a thousand accounts with the same error. The viral analysis of class actions shows that even small cases will give class action attorneys the files and opportunity to hammer a trustee for a variety of failings which would have been ignored as immaterial in most reviews.

The growth of 401 k assets has been the leading factor in the growth of assets under management in the late 1980's and all of the 1990's. The decade of the 2000's will begin the change in focus from 401 k plans to IRA rollovers. The winners in IRA rollover assets will be those who figure out how to break down their internal silos to foster a cooperative effort to make this transfer of assets seamless to their customers and prospects.
The keys of success will include risk management and compliance working with their respective business units to automate transfers of assets between their 401k recordkeeping processors, their brokerage systems and their trust accounting and/or high net worth systems.
